Introduction

1. For convenience, this Privacy Policy (hereinafter: "the Policy") is written in masculine form; all that is stated therein applies to women and men alike.

2. In this Policy, we will explain and clarify what use is made by Beit Israel Food Services Ltd. and/or anyone on its behalf (hereinafter: "Goldy’s") of the information received from you through the Website, which will be processed in the database under its control and management in accordance with the provisions of the Protection of Privacy Law, 5741–1981.

3. Goldy’s hereby clarifies and emphasizes that you are not obligated to provide any personal information about yourself to us during your use of the Website, and any such transfer of information shall be made only with your free will. Please note that failure to provide information may prevent your access to our services, prevent you from completing orders on the Website, and/or impair your browsing or use experience on the Website, in full or in part.

4. Some of our services available through the Website require you to join as a registered user of Goldy’s. Should you choose to register for such a service and provide Goldy’s with personal information for that purpose (such as: joining as a registered user and/or for the purpose of registering to a mailing list), you hereby undertake that you will provide us only with correct, accurate, and complete details, and by providing them, you confirm their accuracy.

5. If you do not provide us with all complete details, or provide incorrect or false details, your use or browsing experience on the Website may be impaired and/or your ability to use our ordering service through the Website may be affected, your ability to complete orders placed through the Website may be frustrated, and/or Goldy's ability to complete the orders you place and/or supply you with the products after your order may be impaired.

Furthermore, providing incorrect or false details may, in certain cases, constitute a breach of the Website's Terms of Use or this Privacy Policy, or even a violation of the law, with all that entails.

6. The Website's current Privacy Policy is available on our website at all times and constitutes an integral part of the Terms of Use for Goldy’s website.

Since the Privacy Policy may change from time to time, Goldy’s recommends that you return to read Goldy's Privacy Policy document periodically.

Notwithstanding the foregoing, should we change this Privacy Policy in a manner that requires, under any law, obtaining your renewed consent for the collection of certain additional personal information about you and/or performing a new action on your existing personal information in our databases, we will post an appropriate notice on our website and/or send you a notice in order to obtain your prior consent to this, by reasonable and accepted means as appropriate to the matter.

7. You are requested to read the Policy carefully, and if you do not agree with its content and/or do not accept it in full, do not make any use of Goldy's Website, where use and browsing are subject to the Terms of Use and this Privacy Policy, which constitutes an integral part of our Terms of Use.

 

The Personal Information Goldy’s Collects About You and the Uses It Makes of It

8. Goldy’s may collect and receive from you through the Website (hereinafter: "user") the types of personal information detailed below, in the following cases:

8.1. Upon joining as a registered user or as a member of Goldy's customer club:

  • 8.1.1. Full name
  • 8.1.2. Email address
  • 8.1.3. Phone number
  • 8.1.4. Login password
  • 8.1.5. (Optional) Address
  • 8.1.6. (Optional) Birthday and/or wedding anniversary

8.2. Upon leaving details for the purpose of holding an event through Goldy’s:

  • 8.2.1. Full name
  • 8.2.2. Email address
  • 8.2.3. Phone number
  • 8.2.4. Any personal information you enter in the "event type" description (free text)

8.3. When placing an order on the Website, we will also collect the following details (to the extent that you add or change existing details, or if you place an order without a user account on the Website as a "guest"):

  • 8.3.1. Email address
  • 8.3.2. Full name
  • 8.3.3. Phone number
  • 8.3.4. (Optional) Company name or licensed dealer and company/VAT registration number accordingly (in the event that you wish to issue an invoice in that name)
  • 8.3.5. Any additional personal information regarding the delivery address in "order notes" (free text boxes)
  • 8.3.6. (Optional) Image or greeting
  • 8.3.7. Credit card token and four digits (through a one-time entry for the purpose of generating the last four digits of the card for saving for future purchases) as detailed in section 20 below
  • 8.3.8. Token of the external payment service account (PayPal, Google Pay, Apple Pay) through which payment was made

Users may also choose to save the last 4 digits of the payment method, as referred to in section 8.3.7 above. Payments will be processed by clearing the card via a secure pop-up window of the clearing company (as defined below in section 18), which generates a token for us at the time of payment processing.

It is clarified that for the purpose of saving a payment method for future purchases, Goldy’s does not save the full payment method details, but rather only receives a token as stated, and the remaining information regarding the payment method is transferred by you directly to the clearing company through its secure page on our website, when you enter it the first time you use the payment method.

8.4. When you contact us or we contact you in response to your request to contact customer service, whether through an electronic form on the Website, a landline telephone number, an email address, or social networks whose details appear on the Website, or through a messaging application (such as WhatsApp), in order for you to receive a response to your inquiry and/or technical assistance and support with your order, we may need to collect personal information from you, including but not limited to:

  • 8.4.1. The content of your inquiry (whether verbal or written)
  • 8.4.2. Phone number
  • 8.4.3. Email address
  • 8.4.4. Full name
  • 8.4.5. Additional identifying information as needed to verify your identity for the purpose of providing the service
  • 8.4.6. Any other personal information you share with our representatives in the course of the conversation, chat, or correspondence with them within the text entered, what is recorded in the call (if recorded), or within an attachment uploaded to the chat/email message

8.5. Upon joining the Company's mailing list, we will collect from you an email address and phone number.

Note: As a benefit for proactive joining through the customer club registration interface on the Website and/or during joining as a "registered user," you will also be entitled to additional benefits, subject to the conditions offered by the Company from time to time. Therefore, subject to your consent to register as aforesaid, additional details may also be collected that will enable verification of your identity, tracking of your purchase history on the Website, and/or delivery of products in accordance with benefits under the Company's policy.

8.6. During regular use of the Website, statistical, identifying, and non-identifying and/or aggregate information may also be collected regarding the user's mobile device and/or computer and/or the consumption habits of users through cookie files and/or additional tools, as detailed further in this Privacy Policy.

9. All information about you in section 8 above that is collected by Goldy’s and/or any such information that Goldy’s uses shall be managed, stored, and used in accordance with all applicable laws.

The Permitted Processing Purposes for Which the Company Will Use Personal Information

All personal information about the user that the Company collects and/or any personal information the Company uses shall be managed and stored in accordance with the provisions of the Protection of Privacy Law, 5741–1981 (hereinafter: "the Law"), and the Company shall use it in accordance with the provisions of this Law and/or in accordance with the provisions of any applicable law, and it shall be used for the following purposes:

10. To enable the operation of the Website and the services offered on it.

11. To monitor the use of the Website by its user base for the purpose of examining the effectiveness of functions, options, or interfaces integrated/built into it, in order to assess the need to add, upgrade, or cancel existing options, functionality, and/or interfaces on the Website, based on non-identifying information.

12. To check the proper functioning and operation of the Website, including quality control and statistical analysis of Website usage, for which purpose the Company will use statistical information that does not personally identify you.

13. Subject to your consent to our use of cookies and tracking tools as stated in sections 33–40 below, the display of marketing and advertising content on the Website in a form personalised to preferences, based on browsing and other uses, or alternatively, the display of generic content not based on preferences should you refuse to enable cookies and tracking tools on your device.

14. To send marketing and advertising messages about the Company's services, including promotions and/or other notices and publications, subject to your consent and your registration to our mailing list and/or customer club through the Website.

15. To analyse usage by users for the purpose of information security on the Website and for the prevention of fraud, impersonation, and/or unauthorised use during registration, browsing, and use of the Website.

16. To contact you when necessary in response to your inquiry via "Contact Us" and/or through any other contact means appearing on the Website, or on any other matter that we require when providing service.

17. To enforce the Privacy Policy and Terms of Use of the Website and/or to act in accordance with the requirements of the law or competent authorities.

 

How Information Is Collected and Used When Making Payments Through the Website

18. Credit card processing for orders placed through the Website will be carried out by Interspace Ltd. (hereinafter referred to as "the clearing company").

19. The clearing company is among the providers of credit card processing services, is authorised to carry out credit clearing operations in accordance with all applicable laws, and also meets all the strict standards and guidelines of the credit card companies for conducting secure internet transactions.

20. Regarding payments, it is clarified that the relevant information for carrying out the transaction is entered in a secure pop-up window of the clearing company, and Goldy’s will not receive said information from the clearing company. Therefore, Goldy’s does not store the full payment method details, except when (if you choose to explicitly allow Goldy’s to do so) it stores a four-digit token that will be used to save the payment method for future orders.

21. It is clarified that the information security standard used by the clearing company, as well as the protection of the credit details and user details transferred to the clearing company, is carried out by the clearing company in accordance with international standards and the instructions of the credit card companies under all applicable law, by the clearing credit card company, and Goldy’s will not be responsible for any violation of user privacy caused by the provision of credit details to the clearing company.

22. Goldy’s does its utmost to protect the integrity of the user's personal information received on the Website and to maintain its confidentiality. However, it is clarified that the collection and storage of information when making a payment are carried out in the secure environment of the clearing company and in accordance with the Privacy Policy and international and local standards that apply to the acquirer as a credit card company.

Furthermore, when you are asked to transfer sensitive personal data to the credit card company, for example credit card details (over the internet) through the Website, this will be done using SSL encryption technologies and/or others used by the clearing company, in a dedicated payment window embedded in the order window in the display, but managed and the information therein reaching only the clearing company.

 

How Goldy’s Collects Statistical and/or Aggregate Information About You and Other Users of the Website

23. When Goldy’s collects personal information about users, as well as statistical-aggregate information related to the manner of use of the Website, it does so through automated means during browsing and use of the Website. Goldy’s will be entitled to collect information about your visits to the Website, your use of the services, and your browsing on the network.

24. This information may include details regarding the location of your computer and/or mobile device, the IP address through which you accessed the Website, your operating system, your browser identifier, location data, browser type, domain names, language settings, and additional information regarding your behaviour on the Website such as information or advertisements you have read, pages and products you have viewed, product orders you have placed, offers and services that interested you, and regarding the manner in which you interact with Goldy's Website and with other websites.

25. Goldy’s may collect personal or aggregate statistical information as aforesaid, also through the use of Cookie files and other tracking technologies (hereinafter together: "cookies"), to the extent that these are activated on the Website, as detailed further below in sections 33–40.

In these cases, and subject to your consent, Goldy’s may collect information relating to Goldy’s products that are associated with and monitored and/or managed through the Website, including information about the user's use of Goldy’s products, such as: product usage habits, duration of product use, time of switching on and off, and any other information regarding the user's use of the product and/or another product connected to Goldy’s products.

26. Goldy’s may engage other companies to provide limited services on its behalf, such as responding to support-related questions, conducting statistical analyses of its services, and/or managing and customising marketing or advertising content on the Website for the user. Goldy’s will provide these companies only with the user's personal information required to provide the services. It is emphasised that in accordance with all applicable law, Goldy’s will contractually bind every such service provider, including its employees required to provide the services to the Company, to the effect that use of such personal information will be made only for the purpose of providing the services as aforesaid and not for any other purpose, as detailed further in sections 42–43 below.

 

Registration for Additional Services (Goldy’s Member Club) and/or for Receiving Direct Mail / Commercial Messages

27. Some of the services on the Website require registration, during which a user must provide personal details such as full name, residential address, telephone/mobile number, and email address. The user therefore hereby declares that these details are provided to the Company of their own free will and with their consent.

28. During the registration process as a registered user on the Website, the user will also be asked to create and enter a password. The Company may, in the future, to the extent required at its discretion for information security and/or compliance with the provisions of any law, determine and/or require that, for certain services on the Website, it will first be necessary to carry out identification through additional means of identification, such as two-step verification and the like. The user alone will be responsible for maintaining the password in confidence in order to prevent its misuse, and the Company recommends changing it from time to time.

29. In this regard, should a user know or suspect that their password has been stolen and/or exposed to unauthorised parties, they are requested to contact the Company as soon as possible in order to freeze access to their registered account and reset their password, by contacting the Company directly through an online form on the Company's website, contacting the Company's service centre at tel. 02-6200100, or by email at: service@goldys.co.il.

30. A user who confirms receipt of direct mail from Goldy’s thereby agrees that upon completion of registration, the user's details will be added to Goldy's mailing list for the sending of messages to the user through various means including but not limited to: messages, email, multimedia messages (MMS), text messages (SMS), an automatic dialling system, and/or through any other means of communication regarding sales promotions, advertising, improvement of the services provided by Goldy’s.

This consent also grants the Company the right to make use of these details for the purposes of sales promotion, advertising, and improvement of the services provided by Goldy’s, in accordance with the provisions of the Communications Law (Telecommunications and Broadcasts) (Amendment No. 40), 5768–2008 (hereinafter: "the Spam Law"). Should a user wish to be removed from the mailing list, they may remove themselves at any time by sending an email to service@goldys.co.il.

31. In addition, if the information in Goldy's databases is used for the purpose of personally approaching the user, based on the user's membership in a population group determined according to one or more characteristics of persons whose names are included in the database (hereinafter: "direct commercial solicitation"), then the user is entitled under the Protection of Privacy Law, 5741–1981 to demand in writing that the information relating to them be deleted from the database, by clicking on the link integrated in the direct mail received and/or by sending an email to service@goldys.co.il.

In such a case, Goldy’s will delete the information it requires only to approach the user with the commercial offers aforesaid. Information required by the Company for the management of its business — including documentation of commercial and other actions carried out by the user on the Goldy’s website — will continue to be stored by the Company in accordance with applicable law, but will no longer be used for the purpose of automated direct marketing.

32. The Company may use the information provided by users on the Website and the information it collects regarding usage patterns on the Website for the purpose of improving the Website's services and/or in any other way it sees fit, for contacting the user when necessary in accordance with the provisions of the Spam Law, or in accordance with any law, or for the purpose of analysing and providing anonymous statistical information to third parties to promote such analyses.

 

The Company's Use of "Cookies" and Tracking Technologies

33. When you enter and browse the Website, certain information may be collected from you through a file implanted on the computer or other electronic device. This file is a "Cookie" file — a small text file stored on the hardware of the computer or electronic device used by you, which is not aware of any other document or file on the computer or other device you use to browse the Website, or other similar files used primarily, among other things, to assist Website visitors in receiving various services and for statistical purposes. For example, cookies enable the Website to be customised according to your device settings and to display content on the Website according to your personal preferences.

The Company uses cookies and tracking tools on the Website to collect information about Website users, as detailed below.

34. What are the purposes of cookie use?

The Company uses cookies to save and manage user settings and preferences selected during visits to the Website, to save returning users' preferences for future use (for example, geographic location, accessibility, and language choices and preferences), for statistical analysis of Website performance and trends, customisation of advertising content and effectiveness of marketing campaigns, and identification and tracking of errors.

35. What types of cookies does the Company use?

The Company makes use of two types of cookies and additional tracking technologies on the Website, as follows:

35.1. Cookies and additional tracking technologies that are technically essential for the operation of the Website — these include the cookies and tracking tools required for the proper operation of the Website, to enable the basic and essential functionality of the Website (for example, user identification and password requests, the ability to browse from page to page, etc.), its security, fraud prevention (blocking DDOS attacks, etc.), and the collection of anonymous traffic data.

35.2. Cookies and/or additional tracking technologies intended for additional purposes. These tools cover additional internal purposes of the Company, such as: statistics, advertising and sales promotion, display improvement and user experience, and we may use this information to analyse traffic patterns, to perform routine system maintenance, or to learn about and improve our Website and services, including:

  • 35.2.1. Analytics Cookies — these cookies collect anonymous data on how users use the Website. They track metrics such as page visits, time spent on pages, bounce rates, and loading speeds to help improve functionality and user experience.
  • 35.2.2. Marketing Cookies — these cookies are designed to track user behaviour for advertising purposes. They collect data on interactions, preferences, and habits, and enable targeted digital marketing, such as personalised advertisements and retargeting campaigns.
  • 35.2.3. Functional Cookies — these cookies improve the user experience by saving preferences such as language settings or personalised layouts. While essential cookies are required for the Website to operate, functional cookies improve usability but are not essential to its basic operation.

36. When will the Company ask you to approve our use of cookies?

39. 40. Please note that we may use external service providers to collect and process the data, in accordance with the purposes of use detailed in section 13 above and the restrictions on the transfer of information to third parties detailed in section 42.2 below.

 

Information Security and Transfer of Information to Third Parties

41. Goldy’s dedicates resources and implements various security measures to prevent intrusions into the database and to thwart potential violations of user privacy. However, breaches and/or disruptions cannot be absolutely prevented. Therefore, the user hereby declares and undertakes that they will have no claim and/or demand and/or lawsuit against Goldy’s and/or anyone on its behalf as a result of vulnerabilities, malfunctions, and/or disruptions as aforesaid and/or exposure of the user's personal details as a result of a breach of the security system and/or unauthorised intrusion into the Website's systems. Goldy’s recommends that users take all possible precautions to protect their personal details while using the internet.

42. For the purpose of operating the Website and providing the services available through it and/or for the purposes of managing the Company's business activity based on processing the personal information of those browsing the Website, the Company may engage with various third parties, as follows:

42.1. The Company will engage service providers to assist us, for various purposes required for its business activity, including:

  • 42.1.1. Operating fraud prevention tools, information security, and/or protection against cyber attacks and malware
  • 42.1.2. Cloud storage services and Software-as-a-Service (SaaS) on which the Website is operated/hosted
  • 42.1.3. Maintenance, design, upgrades, and/or implementation of changes to the Website by our website designers and/or technical support
  • 42.1.4. Conducting statistical analyses regarding the Website, whether aggregate-statistical or identified, for the purpose of examining the effectiveness of commercial campaigns appearing on the Website and/or examining the relevance of parts or content on the Website to our users, and subject to the provisions of this section 42
  • 42.1.5. Providing infrastructure for the purpose of managing the Company's ongoing business operations (cloud service companies for managing information about users (such as a Customer Relationship Management (CRM) system), office software and email providers, and contact platforms, etc.)

42.2. In any engagement with a subcontractor as referred to in sections 42.1 above that involves granting access to personal information, transferring a copy of personal information, or for the purpose of their collection, storage, or processing of personal information about you, the Company undertakes that:

  • 42.2.1. It will take all required measures in accordance with all applicable law for the contractual regulation of granting access or transferring personal information and/or receiving outsourcing services for the processing of personal information about you by those third parties, all in order to protect your privacy in accordance with the obligations imposed on the Company under all applicable law.
  • 42.2.2. To the extent that the engagement of those third parties involves transferring personal information outside Israel, the Company will act in accordance with the obligations applicable to it under the Privacy Protection Regulations (Transfer of Data Outside the Borders of the State), 5761–2001, both in terms of the selection of countries in which the personal information is stored and in terms of the contractual arrangement to ensure your rights and the protection of your privacy in the personal information by the recipient.

43. The personal information collected about users and used by the Company is subject to the rules of the Protection of Privacy Law and the regulations enacted thereunder, including the guidelines and position papers of the Privacy Protection Authority at the Ministry of Justice. Therefore, apart from as stated in sections 42.1 above, the Company refrains from providing or granting access to personal information about you to any third parties, except in the following cases:

43.1. To the extent we are required to do so by court order or to the extent legal proceedings (criminal or civil) are taken against us in connection with actions you carried out through the Website in breach of the Website's Terms of Use and in violation of the law.

43.2. To the extent we are required to do so in order to respond to any legal proceeding, such as a search warrant, court summons, inspection, or enforcement proceeding by a competent regulator or administrative body under any law, or in accordance with another legal instruction.

In such a case, the Company will be entitled to provide user details in accordance with the court order/or the instructions of the enforcement body, and/or the instructions of the competent administrative body, without the need to obtain your prior consent.

43.3. To the extent we are required to enforce our rights under this Privacy Policy or the Website's Terms of Use as a result of your breach thereof, or to the extent a dispute, claim, lawsuit, demand, or legal proceedings arise between you and the Company (including subsidiary and/or related companies) and/or anyone on its behalf.

43.4. To the extent we are required to transfer the Website's operations to the management of another corporation, as well as in the event of a merger with another entity or a merger of the Website's activity with that of a third party.

In such a case, the Company will be entitled to transfer to the third party and/or the absorbing company a copy of the stored information as well as any statistical information collected or processed by it, subject to the third party that will be exposed to it accepting all of the Company's obligations towards you as stated in this Privacy Policy, and undertaking to act in accordance therewith.

 

Links to Third-Party Websites

44. Links may appear on the Website that direct to other websites. Goldy’s makes efforts to link to websites that, to the best of its knowledge, do not violate the right to privacy, however Goldy’s cannot be responsible in any way for the content and/or the degree of privacy protection provided by those websites.

Therefore, the user hereby declares and understands that upon clicking and navigating to a website operated by a third party as aforesaid, Goldy’s is not responsible for any privacy violation and/or other harm due to browsing and/or installation of an application as aforesaid, and Goldy’s recommends that before providing information on such a website, the user read the Terms of Use and/or Privacy Policy of those websites and/or applications and act accordingly.

45. It is clarified that the foregoing also applies to clicking links to social media websites, and all uses will be in accordance with the privacy preferences, privacy terms, and terms of use of each such social media website.

 

The User's Rights Regarding Their Personal Information

46. In accordance with section 13 of the Protection of Privacy Law, you have the right to review the personal information held about you in the Company's databases, subject to a process of verifying and confirming your identity and exercising the right of review in the manner appropriate to the circumstances, all in accordance with the provisions of all applicable law.

47. To the extent that, after such review, you find that the information about you stored in our systems is not correct, complete, clear, or up to date, you are entitled to contact us and ask us to correct such information or alternatively, to delete it in accordance with your rights under section 14 of the Protection of Privacy Law.

48. It is clarified that after having exercised the right of review as stated in section 46 above and wishing to correct the information as stated in section 47 above, you must contact us at the email address: service@goldys.co.il. However, correcting the information may prevent the execution of certain actions you requested in your approach to us, and we will notify you accordingly once the request is complete.

 

Retention of Personal Information

49. We will retain the personal information collected by us through the Website, as stated in this Privacy Policy, only for the period required to fulfil the purposes for which the information was provided to us, and in accordance with the provisions of the law.

50. After the purpose has been fulfilled, or at the end of the period required by law, we will delete the personal information or anonymise it irreversibly in a manner that does not allow personal identification through it, unless as stated there is a legal obligation to continue holding it for a longer period, such as data retention obligations set out in law, active legal proceedings, or active regulatory investigation or enforcement proceedings, and the like.

 

Miscellaneous

51. It is clarified, emphasised, and agreed that registration on the Website and placing orders through it are intended only for users aged 18 and over. Goldy’s does not intentionally or knowingly collect information about minors. 52. Goldy’s may, from time to time, change the provisions of the Policy. Any dispute and/or disagreement in connection with the Policy and/or the terms and/or provisions appearing on the Website, if and to the extent that they arise, will be resolved under the laws of the State of Israel only and exclusively in the competent courts of the city of Jerusalem, which are granted exclusive jurisdiction.

In any case where a condition and/or provision in this document becomes illegal, invalid, or unenforceable, this shall not prevent and/or derogate from the validity and/or legality of the other provisions of this Policy. It is clarified that in such a case, the existence of another similar enforceable condition shall be regarded as replacing the condition that was deleted or removed.
